When public liability is required

Public liability is not mandatory under Singapore statute. It is, however, commonly required by:

  • Commercial landlords — standard tenancy agreements require a tenant to maintain S$1m to S$5m of cover, naming the landlord as additional insured.
  • NEA — certain F&B, hawker and trade licences require public liability cover.
  • LTA / URA — many event and street-use permits require minimum cover.
  • Main contractors — standard sub-contractor terms require evidence of public liability cover.
  • Government tenders — statutory boards routinely require cover as a tender prerequisite.

What public liability covers

A Singapore public liability policy responds to legal liability arising from:

  • Third-party bodily injury — for example, a customer slipping in your premises.
  • Third-party property damage — for example, accidental water damage to a neighbouring tenancy.
  • Defence costs — typically in addition to the policy limit, though some wordings include defence within the limit.

The insurer typically agrees to pay damages the insured becomes legally liable to pay, up to the policy limit, plus reasonable legal costs incurred with the insurer's consent.

Typical exclusions

  • Professional advice (covered separately under professional indemnity).
  • Product defects giving rise to financial loss without bodily injury or property damage.
  • Pollution arising from gradual seepage.
  • Employee injury (covered separately under WICA / employers' liability).
  • Liability assumed under contract beyond the common law.
  • Wear, tear and gradual deterioration.
  • War and terrorism (some insurers offer terrorism cover by extension).

Choosing a limit

Most Singapore SMEs carry S$1m to S$5m of public liability. The right limit depends on:

  • Landlord's contractual minimum (read the tenancy agreement).
  • The severity of a worst-case single claim — a severe-injury slip-and-fall in a busy F&B can exceed S$1m in damages plus defence costs.
  • The number of locations, total footfall and operating hours.
  • Whether the policy will also respond to products liability (combined limit vs separate limit).

  • Personal Injury where insurance required by legislation does not provide indemnity and the lack of indemnity is not due to any breach of legislation relating to Vehicles
  • Watercraft not exceeding 20 metres used by independent contractors, used by others for entertainment purposes, or hand propelled/sailing craft in Singapore territorial or inland waters
  • Sudden and identifiable pollution event — Exclusion 17 does not apply where the claim arises from a sudden, identifiable, unintended and unexpected event which takes place in its entirety at a clearly identifiable point in time and place and occurs outside of North America
  • Subsidiary companies and organisations acquired or constituted during the Policy Period (notified within 90 days and approved in writing)

Exclusions (23)
  • Advertising Injury: a) arising out of a breach of contract, except an implied contract to use another's advertising idea; or b) arising out of the failure of goods, products or services to conform with any statement of quality or performance made; or c) arising out of the wrong description of the price of goods, products or services; d) arising out of knowingly false statements; or e) committed by an Insured whose business is advertising, broadcasting, publishing or telecasting.
  • Aircraft & Aircraft Products: a) the ownership, possession, maintenance, operation or use by or on behalf of the Insured of any: (i) Aircraft including loading or unloading and refueling of any Aircraft; (ii) restricted access areas of an airport including terminals, aerodromes, airstrips, runways or heliports or other area where Aircraft take off or land; (iii) Aircraft hangar or any other area used for storing, sheltering, servicing, maintaining or parking Aircraft; or b) (i) the supply, distribution, sale, lease, hire or manufacture of Aircraft; (ii) the manufacture or supply of parts or Products which are incorporated into the structure, machinery or controls of any Aircraft including any repair, maintenance or servicing thereof.
  • Asbestos: Personal Injury or Property Damage directly or indirectly arising out of, resulting from, in consequence of, contributed to or aggravated by asbestos in whatever form or quantity.
  • Contractual Liability: where the Insured assumes liability under any contract or agreement. Provided this Exclusion 4 a) shall not apply to those written contracts: (i) where such liability would have been implied by law; (ii) where the Insured assumes liability under a warranty of fitness or quality as regards the Insured's Products except to the extent required by law; or (iii) to Incidental Contracts entered into by the Insured; (iv) where the Insured has waived any rights, which but for the existence of such waiver would accrue to the Insured; and (v) any contract designated in Item 6 of the Policy Schedule.
  • Damage to Own Products: Property Damage to the Insured's Products or any part of it if such Property Damage is attributable to any defect therein or the harmful nature or unsuitability thereof.
  • Electronic Data: a) the communication, display, distribution or publication of Electronic Data; or b) the total or partial destruction, distortion, erasure, corruption, alteration, misrepresentation or misappropriation of Electronic Data; or c) error in creating, amending, entering, deleting or using Electronic Data; or d) the total or partial inability or failure to receive, send, access or use Electronic Data for any time or at all, from any cause whatsoever.
  • Expected or Intended: Personal Injury, Property Damage or Advertising Injury expected or intended from the standpoint of the Insured. Provided that this exclusion does not apply to: a) Personal Injury, Property Damage or Advertising Injury resulting from the use of reasonable force to protect persons or property; or b) liability of the Insured for Compensation as the result of an act committed by the Insured's Employees which results in Personal Injury, Property Damage or Advertising Injury expected or intended from the standpoint of the Insured's Employees, provided such act was not committed at the direction of the Insured.
  • Faulty Workmanship: Property Damage to any part of any property that must be repaired, reconditioned or replaced by reason of incorrect work performed by the Insured or on the Insured's behalf, or by reason of materials or equipment which are or are proved to be defective or inadequate in connection with such work, provided this exclusion shall not apply to Personal Injury or Property Damage resulting from such work.
  • Liquidated Damages, Fines & Penalties: a) damages arising out of liquidated damages clauses, penalty clauses except to the extent that such liability would have attached in the absence of such terms; b) civil or criminal fines or penalties; or c) any punitive, aggravated or exemplary damages awarded against the Insured.
  • Libel & Slander: Personal Injury, Property Damage or Advertising Injury arising out of a libel, slander or defamation: a) made prior to the commencement of the Policy Period; or b) made by or at the Insured's direction with knowledge of the falsity or defamatory character thereof.
  • Loss of Use: loss of use of any tangible property which has not been physically damaged or destroyed resulting from: a) a delay in or lack of performance by or on behalf of the Insured of any contract or agreement; or b) the failure of the Insured's Products to meet the level of performance, quality, fitness or durability expressly or implied, warranted or represented by the Insured. Provided that this Exclusion 11 b) does not apply to loss of use of other tangible property resulting from the sudden and accidental physical damage to or destruction of the Insured's Products after such Products have been put to use by any person or organisation other than the Insured.
  • Nuclear & Radioactive Contamination: a) any ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion or fission of nuclear fuel, or b) the radioactive, toxic, explosive or other hazardous properties of any nuclear assembly or nuclear component thereof. Provided this Exclusion does not apply to liability arising from radio-isotopes, radium or radium compounds when used away from the place where such are made or produced and when used exclusively or incidental to ordinary industrial, educational, scientific or medical research.
  • Products Guarantee: any product guarantee or warranty given by or on behalf of the Insured.
  • Product Recall: any cost or expense incurred or claimed for the recall, withdrawal, inspection, removal, repair, replacement, disposal or loss of use of the Insured's Products or of any property of which such Products form a part, if such Products or property are withdrawn from the market or from use because of any known or suspected defect or deficiency therein.
  • Professional Liability: any act, error or omission in the provision of professional advice or service provided for a fee by the Insured other than: a) the rendering of or failure to render professional medical advice by Medical Persons employed by the Insured to provide first aid and other medical services on the Insured's premises.
  • Property Owned or in the Insured's Physical or Legal Control: Property Damage to property owned, leased, hired by, under hire purchase, on loan or rented to the Insured or otherwise in the Insured's care, custody or control other than: a) premises (or to contents therein) temporarily occupied by the Insured for the purpose of carrying out works thereto or thereon; b) premises tenanted by the Insured; c) Vehicles and their contents (not belonging to or used by or on behalf of the Insured) in the Insured's physical or legal control where such Property Damage occurs while any such Vehicle is in a car park owned or operated by the Insured (cover does not apply if the Insured, as part of their Business, owns or operates a car park for reward); d) directors', employees' and visitors' clothing and personal effects; e) goods, equipment, merchandise and property other than real property, subject to cover being limited to a maximum of S$ 250,000 for each Occurrence and in the aggregate during any one Policy Period.
  • Pollution: a) the discharge, dispersal, release, seepage, migration or escape of Pollutants into or upon land, the atmosphere or any watercourse or body of water; b) the cost of removing, monitoring, testing, containing, treating, detoxifying, neutralising, nullifying or cleaning up Pollutants discharged, dispersed, released or escaped into or upon land, the atmosphere or any watercourse or body of water; or c) the cost of preventing the escape of Pollutants. This Exclusion shall not apply where the claim for Compensation arises from a sudden, identifiable, unintended and unexpected event which takes place in its entirety at a clearly identifiable point in time and place and occurs outside of North America.
  • Silica: Personal Injury or Property Damage directly or indirectly caused by or alleged to be caused by or contributed to, in whole or in part, by or arising out of the presence, ingestion, inhalation or absorption of or exposure to silica products, silica fibres, silica dust or silica in any form.
  • Terrorism: Loss, damage, liability, cost or expense of any nature directly or indirectly caused by, resulting from or in connection with any Terrorism, regardless of any other cause or event contributing concurrently or in any other sequence to the loss. Provided that this Exclusion 20 also excludes loss, damage, liability, cost or expense of any nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to any Act of Terrorism.
  • Vehicles: Personal Injury or Property Damage caused by or arising out of the ownership, operation, possession or use by or on behalf of the Insured of any Vehicle which is registered or in respect of which insurance is required by virtue of any legislation or statutory scheme.
  • War: war, invasion, act of a foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, invasion or military or usurped power.
  • Watercraft: Personal Injury or Property Damage caused by or arising out of the ownership, possession, maintenance, operation or use by or on behalf of the Insured of any Watercraft exceeding 20 metres in length, or Hovercraft.
  • Workers' Compensation & Employers' Liability: any liability: a) in respect of which the Insured is or would be entitled to indemnity under any fund, scheme, policy of insurance or self-insurance pursuant to or required by any legislation relating to worker's compensation or accident compensation or any similar law, whether or not such insurance has been effected; or b) imposed by the provisions of any industrial award, agreement or determination where such liability would not have been imposed in the absence of such industrial award, agreement or determination; or c) relating to Employment Practices.
Defined terms (27)
Advertising Injury
means a) libel, slander or defamation; b) infringement of copyright or passing off of a title or slogan; c) unfair competition, piracy or idea misappropriation contrary to an implied contract; and d) invasion of privacy, committed or alleged to have been committed during the Policy Period in any advertisement, publicity article, broadcast or telecast and caused by or arising out of any advertising activities conducted by or on the Insured's behalf in carrying out the Insured's Business.
Aircraft
means Vehicle, vessel or thing designed to be used primarily in the air and to be supported by the dynamic reaction of the air upon the Vehicle's, vessel's or thing's wings or rotor-blades, or by the Vehicle's, vessel's or thing's buoyancy in the air or atmosphere.
Business
means activities and operations of the Insured specified in Item 2 of the Policy Schedule and includes: a) the ownership, tenancy or occupation of premises by the Insured including the repair and maintenance of property which the Insured owns or is responsible for; b) private work carried out with the consent of the Insured for any director, partner or senior official of the Insured by an Employee provided the Employee is qualified to undertake such work; c) the provision or management of catering, social, welfare or child care facilities, sports and related facilities for the benefit of the Insured's Employees; d) the provision of the Insured's own internal fire, first aid, medical, security and ambulance services; e) participation in an exhibition, trade fair or conference by the Insured; f) conducted tours of the Insureds premises; and g) the provision of sponsorship by the Insured.
Compensation
means monies paid or agreed to be paid by final judgment or settlement in respect of Personal Injury, Property Damage or Advertising Injury to which this Policy applies.
Computer Virus
means an executable programme or computer code segment that is self-replicating, requires a host programme or executable segment in which it can be contained, and which destroys or alters the host-programme or other computer code or data, causing undesired programme or computer system operation.
Deductible
means the uninsured first portion of each and every Occurrence which is payable by the Insured as specified in Item 5 of the Policy Schedule. The Deductible applies to all amounts payable under this Policy including but not limited to amounts payable under Item 3 of The Cover, Defence Costs & Supplementary Payments. In the event that more than one deductible is payable for any Occurrence, then only the highest Deductible amount stated in Item 5 of the Policy Schedule will apply.
Electronic Data
means facts, concepts and information converted to a form useable for communications, display, distribution, interpretation or processing by electronic and electromechanical data processing or electronically controlled equipment and includes programmes, software and other coded instruction for such equipment.
Employee
means any person employed or deemed to be employed by the Insured whether pursuant to any Workers' Compensation Law or otherwise, including but not limited to any: a) person under a contract of service or apprenticeship with the Insured; b) self-employed person working under contract with the Insured and under its direction; and c) student or person undertaking work for the Insured under a work experience of similar scheme.
Employment Practices
means any wrongful or unfair dismissal, denial of natural justice, defamation, misleading representation or advertising, sexual harassment or discrimination in respect of employment or prospective employment by the Insured.
Hovercraft
means any vessel, craft or device made to float on or in, or travel on or through the atmosphere or water on a cushion of air provided by a downward blast.
Incidental Contracts
means a) any written agreement or lease of real or personal property which does not impose upon the Insured: (i) an obligation to insure such property; or (ii) any liability regardless of fault; b) any written contract with any public authority for the supply of water, gas or electricity, telephone and communication services, waste disposal facilities or other essential services but only to the extent of indemnifying any such public authority in respect of liability arising out of the Business other than contracts for the performance of work or provision of services by the Insured; and c) those contracts designated in the Policy Schedule.
Insured
means a) the Named Insured specified in the Policy Schedule; b) any subsidiary company (including subsidiaries thereof) of the Named Insured and any other organisation under the control and active management of the Named Insured; c) any subsidiary company or organisation under the control and management of the Named Insured which are constituted or acquired by the Named Insured during the Policy Period, provided always that: (i) such constitution or acquisition is notified to us within 90 days of it first occurring and is approved by us in writing; (ii) in our absolute discretion we may apply any additional premium. d) the Named Insured's partners, executive officers, Employees, directors, shareholders or volunteers while acting within the scope of their duties on behalf of the Named Insured's Business; e) any principal to whom the Insured, designated in subparagraphs a) and b) above, is obligated by written contract or agreement to provide insurance, but only in respect of the principal's liability arising out of operations conducted by the Insured or on their behalf, and only to the extent required by such contract or agreement and in any event only for such coverage and Limit of Liability as provided by this Policy and excluding the sole negligence of the principal; and f) any office bearer or member of social or sporting clubs formed with the written consent of the Named Insured whilst acting within the scope of their duties connected with activities of any such club.
Medical Persons
means qualified medical practitioners, medical nurses, dentists and first aid attendants.
Named Insured
means the entity specified in Item 1 of the Policy Schedule.
North America
means a) the United States of America or Canada; b) any state, territory or protectorate incorporated in, or administered by the United States of America and/or Canada; and c) any country or territory subject to the laws of the United States of America or Canada.
Occurrence
means an event, including continuous or repeated exposure to substantially the same general conditions, which results in Personal Injury, Property Damage or Advertising Injury that is neither expected nor intended from the Insured's standpoint during the Policy Period. With respect to Personal Injury or Property Damage, all events of a series consequent on or attributable to one source or original cause shall be deemed one Occurrence. All Advertising Injury arising out of the same injurious material or act, regardless of the frequency or repetition thereof, the number and kind of media used or the number of claimants, shall be deemed to be one Occurrence.
Personal Injury
means a) death, bodily injury, sickness or disease sustained by a person and shall include mental injury, mental anguish, shock and loss of consortium; b) false arrest, false imprisonment, wrongful eviction, wrongful detention and malicious prosecution; c) libel, slander, defamation of character or invasion of privacy unless arising out of Advertising Injury; and d) assault and battery committed by or at the direction of the Insured whilst engaged in Business and for the purpose of preventing or eliminating danger to persons or property.
Policy Period
means the period specified in Item 3 of the Policy Schedule, or any shorter period arising as a result of cancellation of this Policy or other period for which the Policy has been altered as agreed by us in writing.
Pollutants
means but is not limited to any solid, liquid, biological, radiological, gaseous or thermal irritant or contaminant whether occurring naturally or otherwise, including but not limited to smoke, vapour, soot, fumes, acids or alkalis of any sort, chemicals and waste. Waste includes but is not limited to material to be recycled, reconditioned or reclaimed.
Products
means any goods or products which are or are deemed (whether by law or otherwise) to have been manufactured, constructed, grown, extracted, treated, imported, exported, produced, processed, assembled, erected, installed, repaired, serviced, treated, sold, supplied or distributed by the Insured, including but not limited to any packaging or labelling on, or containers holding, the good or product. Products also include the design, formulae, specifications, directions, instructions, advice or warning given or omitted to be given in connection with such products.
Products Liability
means Personal Injury or Property Damage arising out of the Insured's Products but only if the Personal Injury or Property Damage occurs away from premises owned by, leased to, rented to or occupied by the Insured and after physical possession or control of such products has been relinquished to others.
Property Damage
means a) physical damage to or destruction of tangible property including the loss of use of that property thereof. All such loss of use shall be deemed to happen at the time of the physical damage that caused it; or b) loss of use of tangible property which has not been physically damaged or destroyed provided such loss of use is caused by physical damage to or destruction of other tangible property which first happened during the Policy Period.
Territorial Limits
means a) anywhere in the world except in North America; b) North America but only where legally liable to pay as Compensation in respect of Personal Injury, Property Damage or Advertising Injury arising out of: (i) non-manual work carried out by the Insured's Employees, directors, officers or executives who are normally non-resident in North America; or (ii) the Insured's Products exported without the knowledge of the Insured to North America.
Terrorism
means the use or threatened use of force or violence against person or property, or commission of an act dangerous to human life or property, or commission of an act that interferes with or disrupts an electronic or communication system, undertaken by any person or group, whether or not acting on behalf of or in connection with any organisation, government, power, authority or military force, when the effect is to intimidate or coerce a government, the civilian population or any segment thereof, or to disrupt any segment of the economy. Terrorism shall also include any act which is verified or recognised by the government of any country in which the Insured operates or exports products into, as an act of terrorism.
Tool of Trade
means any Vehicle which has attached as an integral part of such Vehicle any equipment for mechanical digging, scraping, grading, slashing, mowing, drilling, lifting or levelling, whilst such equipment is being used for the purpose for which it was designed. Tool of Trade does not include any Vehicle whilst travelling to or from a Worksite or any Vehicle that is used to carry goods to or from any premises.
Vehicle
means any type of machine on wheels or on caterpillar tracks made or intended to be self-propelled by mechanical power, and any trailer or other attachment to be used in conjunction with any such machine.
Watercraft
means any vessel or craft made to or intended to float on or in or travel on or through or under water.

Exclusions (29)
  • 4.1 INJURY TO EMPLOYEES — Personal Injury to any employees of the Insured arising directly or indirectly out of or in the course of their employment in the Business of the Insured.
  • 4.1.2 Any liability the Insured may have in respect of Personal Injury sustained to any person who is, pursuant to any legislation relating to workmen's compensation, deemed or defined to be an employee of the Insured.
  • 4.1.3 Any liability in respect of which the Insured is entitled to seek indemnity under any policy of insurance required to be taken out pursuant to any legislation relating to workmen's compensation whether or not the Insured is party to such contract of insurance.
  • 4.1.4 Any liability imposed by the provisions of any workmen's compensation legislation or any industrial award or agreement or determination.
  • 4.2 PROPERTY IN CUSTODY OR CONTROL — Property Damage to property owned by or leased or rented to the Insured; or property in the physical or legal control of the Insured.
  • 4.3 INSURED'S PRODUCT — Claims arising directly or indirectly out of any defect or deficiency in goods sold or supplied after such goods have passed from the control and actual physical custody of the Insured or of any person in the direct service of the Insured other than goods sold or supplied at or from a canteen provided by the Insured primarily for the use of Employees of the Insured.
  • 4.4 LOSS OF USE — Loss of use of tangible property which has not been physically injured or destroyed resulting from a delay in or lack of performance by or on behalf of the Insured of any contract or agreement.
  • 4.5 PRESSURE VESSELS — Claims in respect of bodily injury or property damage arising directly or indirectly from explosion or collapse of boilers, steam generators or other vessels under pressure owned by the Insured or in the physical or legal control or used by the Insured and in respect of which a certificate is required to be issued under the terms of any Statute or Regulation thereunder, provided however that this exclusion does not apply to pressure vessels with a capacity of one cubic metre or less.
  • 4.6 AIRCRAFT AND WATERCRAFT — Claims arising out of the ownership, maintenance, operation or use by the Insured of any Aircraft, hovercraft, or any Watercraft or vessel.
  • 4.7 VEHICLES — Personal Injury or Property Damage arising out of the ownership, possession, operation, control, maintenance or use by the Insured of any Vehicle which is registered; or which is required under any legislation to be registered; or in respect of which insurance is required to be effected by or on behalf of the Insured by or under any legislation whether or not such insurance is affected.
  • 4.8 CONTRACTUAL LIABILITY — Liability assumed by the Insured under any contract or agreement except to the extent that such liability would have been implied by law.
  • 4.9 BUILDING WORK — Claims in respect of bodily injury or property damage arising directly or indirectly out of or caused by or in connection with the erection demolition, alteration of and/or addition to buildings by or on behalf of the Insured except such erection, demolition, alteration, or addition not exceeding the sum of RM20,000.
  • 4.10 VIBRATION — Claims in respect of damage to any land or fixed property arising directly or indirectly from vibration.
  • 4.11 PROFESSIONAL LIABILITY — The rendering of or failure to render professional advice or service by the Insured or any error or omission connected therewith but this exclusion does not apply to the rendering or failure to render professional medical advice by Medical Persons employed by the Insured to provide first aid and other medical services on the Insured's premises.
  • 4.12 LIBEL AND SLANDER — Liability arising out of the publication or utterance of a libel or slander.
  • 4.13 RADIOACTIVITY — Personal Injury or Property Damage directly or indirectly caused by contributed to or arising from ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel; or nuclear weapons material.
  • 4.14 WAR — Any consequence of war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power, or expropriation, including lawful seizure, resumption, confiscation, nationalisation, destruction or damage to property by or under the order of any Government or public or local authority.
  • 4.15.1 POLLUTION — Personal Injury or Property Damage caused by or arising out of the discharge, dispersal, release or escape of Pollutants into or upon land, the atmosphere, or any water course or body of water. Provided that this exclusion does not apply if such discharge, dispersal, release or escape is sudden, identifiable, unexpected and unintended and takes place in its entirety at a specific time and place.
  • 4.15.2 Any costs and expenses incurred in the prevention, removing, nullifying or clean-up of such contamination or pollution provided that this exclusion 4.15.2 shall not apply to clean-up, removal or nullifying expenses only, which are consequent upon a sudden, identifiable, unexpected, unintended happening taking place in its entirety at a specific time and place which results in Personal Injury and/or Property Damage.
  • 4.15.3 The actual, alleged or threatened discharge, dispersal, release, seepage, migration or escape of pollutants in the United States of America or Canada or in any country to which the laws of the United States of America or Canada apply.
  • 4.16 ASBESTOS — Any actual or alleged liability whatsoever for any claim or claims in respect of loss or losses directly or indirectly arising out of, resulting from, in consequence of, contributed to or aggravated by asbestos in whatever form or quantity.
  • 4.17 FAULTY WORKMANSHIP — The cost of performing completing, correcting or improving any work undertaken by the Insured.
  • 4.18 FINES, PENALTIES — Fines, penalties or liquidated damages.
  • 4.19.1 TERRITORIAL AND JURISDICTIONAL LIMITS — Claims made and actions instituted within the United States of America or the Dominion of Canada or any other territory coming within the jurisdiction of the courts of the United States of America or the Dominion of Canada.
  • 4.19.2 Claims and actions to which the laws of the United States of America or the Dominion of Canada apply.
  • 4.20 TERRORISM — Loss damage, death, injury, illness, cost or expense of whatsoever nature directly or indirectly caused by resulting from or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss.
  • 4.21.1 INTERNET OPERATIONS — Personal injury or property damage arising, directly or indirectly, out of, or in any way involving the insured's 'Internet Operations'.
  • 4.21.2 COMPUTER DATA DAMAGE — Property damage to computer data or programs and their storage media arising directly or indirectly out of or caused by, through or in connection with the use of any computer hardware or software; the provision of computer or telecommunication services by the insured or on the insured's behalf; or the use of computer hardware or software belonging to any third party, whether authorised or unauthorised including damage caused by any computer virus.
  • 4.22 ELECTRONIC DATE EXCLUSION CLAUSE — Any claim arising directly or indirectly caused by or contributed to by or arising from the failure or inability of any computer equipment to correctly recognise any date as its true calendar date, prior to, during or after the Year 2000 or any other date.
Defined terms (15)
Insured
The named Insured specified in the Schedule; every Director, Executive Officer, Employee, Partner or Shareholder of the Insured but only whilst acting within the scope of their duties in such capacity; every principal, in respect of the liability of such principal arising out of the performance by the Insured of any contract or agreement for the performance of work of such principal, to the extent required by such contract or agreement; every office bearer or member of sporting clubs, canteen and welfare organisation and first aid, fire and ambulance services formed with the consent of the Insured; each partner, joint venturer, co-venturer or joint lease of the named Insured but only with respect to liability incurred as the partnership, joint venture, co-venture, joint lease and provided the partnership, joint venture, co-venture, joint lease has been notified to the Company; any director or senior executive of the Insured in respect of private work undertaken by the Insured's employees for such director or senior executive.
Personal Injury
Bodily injury (which expression includes death and illness), disability, shock, fright, mental anguish or mental injury.
Property Damage
Physical injury to or destruction of tangible property including the loss of use thereof at any time resulting therefrom, or loss of use of tangible property which has not been physically injured or destroyed provided such loss of use is caused by an Occurrence.
Occurrence
An event, including continuous or repeated exposure to substantially the same general conditions which results in Personal Injury, or Property Damage, neither expected nor intended from the standpoint of the Insured.
Medical Persons
Qualified medical practitioner, qualified registered nurse, dentists and first aid attendants.
Insured's Products
Any goods, products or property after they have ceased to be in the Insured's possession or under the control of the Insured, manufactured, constructed, erected, installed, repaired, serviced, treated, sold, supplied, distributed by the Insured (including any container thereof other than a Vehicle).
Vehicle
Any type of machine on wheels or on self laid tracks made or intended to be propelled by other than manual or animal power and any trailer or other attachment made or intended to be drawn by any such machine.
Watercraft
Any vessel, craft or thing made or intended to float on or in or travel on or through water.
Aircraft
Any vessel, craft or thing made or intended to fly or move in or through the atmosphere or space.
Pollutants
Any solid, liquid, gaseous or thermal irritant or contaminant, including but not limited to smoke, vapour, soot, fumes, acids, alkalis, chemicals and waste. Waste includes material to be recycled, reconditioned or reclaimed.
Policy
This document and each memorandum issued by the Company and attached, or intended to be attached, to it.
Business
Shall include the provision and management of canteens, social, sports and welfare organisations for the benefit of the Insured's employees and first aid, fire and ambulance services and maintenance of the Insured's premises.
Employee
Any person engaged under a contract of service or apprenticeship with the Insured, but does not include any person employed under such contract who is excluded from the definition of 'worker' under any workers' compensation legislation.
Internet Operations
Use of electronic mail systems by the insured or the insured's employees, including part-time and temporary staff, contractors and others within the insured's organisation; access through the insured's network to the world wide web or a public internet site by the insured's employees, including part-time and temporary staff, contractors and others within the insured's organisation; access to the insured's intranet which is made available through the world wide web for customers of the insured or others outside the insured's organisation; the operation and maintenance of the insured's web site.
Territorial Limits
Worldwide unless otherwise specified in the Schedule, subject to the provisions of Exclusion 4.19.
